twitchshop.gg is not affiliated with or endorsed by Twitch Interactive, Inc. or any of its affiliates. We are an independent entity providing services for Twitch users, and any references to Twitch or its products are made solely for the purpose of identifying compatibility with our services.

1. Account Damages:
twitchshop.gg is not responsible for any damages done to your Twitch account as a result of using our services. It is your responsibility to ensure that your account is secure and that you follow Twitch's terms of service.

2. Sales:
All sales are final, and refunds are generally not given. However, some orders may be eligible for a refund or exchange under certain conditions. Please review our refund and exchange policy here for more information. Additionally, exchanges of services may be possible at the discretion of Twitch Shop.

3. Compensation:
In the event that your Prime revenue is lower than $1.2 per subscriber, we may offer compensation at our discretion. However, we are not obligated to provide any compensation beyond this amount.

4. No Guarantees:
We make no guarantees regarding the success or effectiveness of our services. We do our best to provide quality services, but results may vary.

5. Limitation of Liability:
twitchshop.gg shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses.

6. Indemnification:
You agree to indemnify and hold twitchshop.gg and its affiliates, officers, agents, employees, and partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of our services, your violation of these terms of service, or your violation of any rights of another.

7. Weekly / Monthly Service Refund Policy:
In the event that any of our weekly or monthly services, including the Chatbot Service or Liveviewer Service, cease to function abruptly, we will provide a refund in the form of store credit equivalent to the prorated value of the remaining subscription period. The prorated value will be calculated based on the proportion of the unused days in the subscription period with a maximum store credit limit of $15. However, it is important to note that occasional downtime may occur but is rare, and if the downtime does not exceed 24 hours, a refund in store credit will not be provided.

8. Email Domain Policy for Onboarded Affiliate Accounts
For users who have purchased our services and are utilizing onboarded affiliate accounts hosted on email domains provided by twitchmail.xyz, the following policy applies:

8.1 Email Domain Deletion:
Email accounts hosted on twitchmail.xyz that are primarily used for our onboarded affiliate accounts can be automatically deleted 60 days after the purchase of the associated account.

8.2 Customer Responsibility:
It is the responsibility of the customer to ensure that the email associated with their onboarded affiliate account is changed within the 60-day period from the date of purchasing the associated account name. Failing to update the email within this period may result in the deletion of the associated email account.

8.3 Loss of Access After 60 Days:
In cases where a customer loses access to their email account hosted on twitchmail.xyz after the 60-day period and has not changed the email to an address of their own, twitchshop.gg cannot be held responsible. It is the customer's responsibility to update it as needed within the given timeframe.
We strongly recommend that customers promptly update their email addresses associated with onboarded affiliate accounts to avoid any potential loss of access. By using our services and utilizing onboarded affiliate accounts, you acknowledge and agree to adhere to these email domain policies.


9. Channel Details, Order Fulfillment, and Chat Settings for Twitch Channels
Channel Details
It is the responsibility of the customer to provide accurate and complete channel details for the delivery of our products or services, specifically for Twitch channels. This includes the Twitch channel username and any additional information required for the requested service.

9.2 Inaccurate Information
In the event that incorrect or insufficient channel details are provided by the customer, we reserve the right to reach out to the customer to rectify the situation. We may use the contact information provided during the ordering process to communicate with the customer for this purpose.

9.3 Inaccurate Information Delivery Delay
We are not responsible for delays, non-deliveries, or other issues that arise due to inaccurate or incomplete channel details provided by the customer.

10. Order Fulfillment
Upon successful processing and preparation of an order related to a Twitch channel, we will make reasonable attempts to deliver the product or service to the customer through the provided Twitch channel details.

10.2 Delivery Communication Policy
If the customer fails to receive or acknowledge the delivery, or if the provided Twitch channel details are incorrect or non-functional, we will attempt to reach out to the customer using the contact information provided during the ordering process.

10.3 Order Fulfillment Deadline Policy
In cases where the customer does not respond within a reasonable time frame or does not attempt to resolve the issues related to incorrect or non-functional Twitch channel details / order details, we reserve the right to mark the order as fulfilled after an 18-day period has elapsed from the date of the original order. The customer will be informed of this action via the contact information provided
.
10.4 Reprocessing Policy
Once an order is marked as fulfilled due to the reasons mentioned in section 11.3, further requests for delivery or reprocessing of the order may be subject to additional charges or fees, and fulfillment will be at our discretion.

11. Account Bans
If the customer's Twitch channel is banned or experiences restrictions shortly after placing an order, the customer is encouraged to reach out to our support team promptly. This can be done by contacting support@twitchshop.gg, or via Discord.

Our support team will make every effort to assist the customer in resolving issues related to Twitch channel bans or restrictions in a timely manner.

11.1 Non-Liability for Service Interruption Due to Account Bans Policy
We are not responsible for any missed days for any of our weekly/monthly packages, such as live viewers and chatters, or for any of our other products that have been delivered, in case the account gets banned.


12. Blacklisting and Service Suspension Policy:

12.1 Grounds for Immediate Blacklisting:
Violation of terms of service, including abusive behavior, fraud, illegal activities, non-payment, stealing customers, threatening chargebacks, and actual chargebacks. Additionally, we reserve the right to blacklist individuals at our discretion, without providing specific reasons.

12.2 Authorization and Execution:
Authorized personnel may immediately blacklist a customer and suspend their services upon confirmed violation.

12.3 Service Suspension Process:
Services will be stopped immediately upon blacklisting and may only resume upon resolution or meeting specified conditions, no refunds will be given.

12.4 Communication and Notification:
Customers will be promptly notified of the blacklisting and reasons for service suspension. Please note that since we reserve the right to blacklist individuals at our discretion without providing specific reasons, a reason may not be available.


13. Chargeback Policy
13.1 No Tolerance on Chargebacks:
We maintain a strict no tolerance policy on chargebacks. Chargebacks are harmful and can negatively impact our business, especially as a small enterprise.
13.2 Contact Customer Support:
If you have any issues with a purchase, we encourage you to contact our customer support team through the channels provided on our website or via our Discord at discord.gg/twitchshop for assistance in resolving any disputes or concerns.

13.3 False Chargebacks and Disclosure of Information
13.3.1 False Chargeback Defined:
A "false chargeback" refers to a chargeback that is initiated without valid reason, including but not limited to circumstances where a customer has received the product or service as described on the Site and subsequently disputes the transaction with their financial institution.
13.3.2 Disclosure of Information:
In the event of a false chargeback, we reserve the right to disclose information relevant to the chargeback dispute to third parties, including but not limited to Twitch. This information may include, but is not limited to:
- Twitch channel details - IP addresses - Personal details we have on record
In the case of a false chargeback, we may provide the information to Twitch as part of our efforts to protect our business and enforce our no tolerance chargeback policy.

14.4 Additional False Chargeback Measures
14.4.1 Ban from Twitchshop.gg:
In addition to disclosing information as outlined in Section 14.3.2, we may take further measures to protect our business and enforce our no tolerance chargeback policy. Such measures may include a ban from making purchases on the Site, also known as twitchshop.gg.

14.4.2 Dispute Resolution Process:
We encourage users to contact our customer support team to resolve any issues or disputes related to their purchases. We are committed to resolving disputes in a fair and reasonable manner.

14. Credit Card Processing Time Policy:
All orders made with a card are subject to a 3 workday processing time. After 3 workdays, the order will be delivered or fulfilled.

14.1 Exclusions
Accounts and programs such as our AdBot are excluded from the Credit Card Processing Time Policy, Payments made with card via PayPal are also excluded.

Policy Updates
We may update this Policy at our discretion. Any changes to this Policy will be posted on the Site, and it is your responsibility to review it periodically.
